Privacy Policy

Effective October 1, 2026

AVIÑA (“we,” “our,” or “us”) respects your privacy. This Privacy Policy explains how information is collected, used, disclosed, and handled when you visit our website, submit information through our forms, sign up to receive communications, scan certain AVIÑA QR codes, or otherwise interact with us online.

This policy applies to information collected through our website, including Avina.wine and Aviña.wine, and pages, forms, links, and QR codes associated with those sites.

Information We Collect

Information You Provide

We collect information that you choose to provide to us, which may include:

  • your name;

  • email address;

  • phone number, if provided;

  • your communication preferences and opt-in status;

  • information you submit through a website form; and

  • information you provide when contacting us directly.

You are not required to provide personal information simply to browse our website.

When you submit information through a form on our website, we collect the information requested in that form so that we can maintain our mailing list, respond to submissions, communicate with you when requested, and manage our relationship with you.

Information Collected When You Visit the Website

Our website is hosted by Squarespace. When you visit the website, Squarespace and AVIÑA may collect certain technical and usage information, including:

  • your IP address;

  • information about your browser, network, and device;

  • webpages you visited before arriving at our website;

  • pages you view while using our website;

  • clicks and internal links;

  • scrolling and searches;

  • timestamps; and

  • other information about how you interact with the website.

We use this information to operate the website, understand site traffic and visitor activity, improve the website experience, protect the site, and evaluate how visitors find and use AVIÑA’s online materials.

Squarespace may also process certain website-usage information for its own purposes in accordance with its privacy practices.

QR Codes and Tracked Links

Some AVIÑA materials may contain dynamic QR codes or tracked links provided through Uniqode or similar services.

When you scan a tracked QR code, information about the scan may be collected before you are directed to our website. Depending on the QR code, our account settings, and the services enabled, this may include:

  • the date and time of the scan;

  • whether a scan is unique or repeated;

  • device type;

  • operating system;

  • browser information;

  • approximate geographic location derived from an IP address;

  • the QR code or campaign associated with the scan; and

  • the destination URL or subsequent engagement associated with that interaction.

A standard QR-code scan does not by itself provide us with your name, email address, or phone number. We receive personally identifiable contact information only when you choose to provide it, such as by submitting a form.

Uniqode may offer precise GPS-based location analytics. If we enable that functionality, precise location information is collected only after your device requests location access and you choose to permit it.

We use QR-code and link analytics to understand how people discover AVIÑA, measure the effectiveness of printed and digital materials, and improve our communications.

How We Use Information

We may use information we collect to:

  • maintain and manage our mailing list;

  • send occasional vineyard notes, company news, future release information, and other AVIÑA communications when you have chosen to receive them;

  • respond to questions, inquiries, or requests;

  • manage and respond to website-form submissions;

  • understand how visitors discover and interact with our website;

  • measure the effectiveness of QR codes, links, and other outreach;

  • improve and protect our website and online services;

  • maintain records relating to communications and privacy preferences;

  • prevent misuse, fraud, or security incidents; and

  • comply with applicable legal obligations.

Providing your phone number does not constitute consent to receive marketing text messages. We will not send marketing SMS messages unless you separately provide consent to receive them.

Email Communications and Your Choices

If you have opted in to receive communications from AVIÑA, you may unsubscribe at any time by using the unsubscribe option included in our marketing emails or by contacting us.

You may also contact us to request that we update, correct, or delete personal information you have provided to us, subject to information we may need to retain for legal, administrative, security, or legitimate business purposes.

If you ask us to unsubscribe you and delete information associated with your mailing-list registration, we may retain a limited record of your request where necessary to ensure that your preference is honored and to comply with applicable law.

Cookies and Similar Technologies

Our website uses cookies and similar technologies.

Certain necessary or functional cookies may be used to allow Squarespace to securely provide and operate the website. Depending on our website settings and your consent choices, analytics and performance cookies may also be used to measure website traffic, activity, and usage.

Cookies and similar technologies may allow us or our service providers to recognize a browser or device, maintain website functionality, understand how the website is used, and measure performance.

Where required, we may provide a cookie notice or consent mechanism allowing visitors to manage non-essential cookies.

Third-party tools or services that we add to the website may also use their own cookies or similar technologies. Their use of information is governed by their respective privacy policies.

Squarespace

We use Squarespace to host and operate our website and website forms.

When you submit information through an AVIÑA form, that information is provided to Squarespace so that Squarespace can provide website and form services to us and help us manage the submission.

Squarespace also receives certain technical information from website visitors, including browser, network, device, IP-address, referral, and website-interaction information.

Squarespace may process some information on our behalf and may process certain site-usage information for its own purposes as described in its Privacy Policy and Cookie Policy.

Uniqode

We use Uniqode to create and manage certain dynamic QR codes and to measure QR-code engagement.

In connection with those services, Uniqode may process scan and technical information on our behalf, including device information, browser or operating-system information, timestamps, IP-derived approximate location, campaign information, and other QR-code interaction data.

Where Uniqode processes personal information contained in our service data on our behalf, Uniqode describes AVIÑA as the customer/controller and Uniqode as the service provider or processor.

We do not use a QR-code scan alone to identify an individual by name.

If precise GPS tracking is enabled for a particular QR code, the scanner’s device will request permission before precise location information is made available.

Other Service Providers

We may use other third-party service providers to help us operate our website, maintain communications, store information, analyze website activity, provide technical services, or support our business.

These providers may receive or process information only as necessary to perform services for us or as otherwise permitted under their own applicable terms, privacy policies, and law.

Our service providers may change as AVIÑA develops.

Sale and Disclosure of Personal Information

We do not sell personal information that you submit to us.

We do not provide your contact information to unrelated third parties for their own direct marketing purposes.

We may disclose information to service providers that perform services on our behalf, including website hosting, form processing, communications, analytics, QR-code services, and technical support.

We may also disclose information when reasonably necessary to:

  • comply with applicable law, regulation, subpoena, court order, or other legal process;

  • respond to lawful requests from governmental or regulatory authorities;

  • protect the rights, property, safety, or security of AVIÑA, our users, service providers, or others;

  • investigate, prevent, or respond to fraud, misuse, security incidents, or unlawful activity; or

  • establish, exercise, or defend legal claims.

If AVIÑA undergoes a merger, acquisition, restructuring, financing, sale of assets, or similar business transaction, information maintained by the business may be transferred as part of that transaction, subject to applicable law.

Data Retention

We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including maintaining communication preferences, responding to requests, operating our business, complying with legal obligations, resolving disputes, and protecting our rights.

Retention periods may vary depending on the type of information and the systems or service providers used to process it.

Security

We take reasonable administrative and technical measures intended to protect personal information under our control.

We also rely on service providers, including Squarespace and Uniqode, that maintain their own security measures for the services they provide.

However, no website, electronic transmission, or electronic-storage system can be guaranteed to be completely secure, and we cannot guarantee the absolute security of information transmitted or stored electronically.

Age and Alcohol-Related Content

AVIÑA is a wine-related business. Our website and communications are intended for adults of legal drinking age in the jurisdiction where they are viewed.

We do not knowingly seek to collect personal information from individuals who are not of legal drinking age.

If you believe information has been submitted to us by someone who is not legally permitted to access alcohol-related content, please contact us so that we can review the matter and, where appropriate, delete the information.

Links to Other Websites and Services

Our website may contain links to third-party websites or services, including social-media platforms.

We do not control and are not responsible for the privacy, security, or content practices of third-party websites or services. When you follow a link away from our website, the third party’s own privacy policy and terms apply.

California and Other Privacy Rights

Depending on where you reside, the laws applicable to AVIÑA, and the nature and scale of our operations, you may have rights concerning your personal information.

These may include rights to request access to, correction of, or deletion of certain personal information.

You may contact us regarding any privacy request. We may need to verify your identity before completing certain requests.

Nothing in this Privacy Policy is intended to limit any rights available to you under applicable law.

Changes to This Privacy Policy

We may update this Privacy Policy as our website, service providers, business practices, or legal obligations change.

When we make changes, we will post the revised Privacy Policy on this page and update the effective date above.

If a change materially alters how we use personal information that you previously provided, we will provide any additional notice required by applicable law.
